I agree with you Fluffy but the way the various departments see it ... that's the trouble with chimney funding and all this ruddy value for money ... in the short term money saving in the long run however it costs the tax payer a lot more.

I know what you mean Miriam, but whichever department funds all this, it`s all coming from public money - that`s the annoying thing about it!

"Mrs Law told the court: "The singing didn't sound normal to me, it was just a high-pitched noise. "

Sounds like most hit music to me...someone will sign here and she will move to France. End of problem.

I agree ... however it is a question of funding I should imagine. You see, if the local authority could force people to attend mediation sessions then they would have to fund these sessions - even if not the entire cost at least some of the costs. Whereas going through the courts means that the onus of funding is not on them. Then, when the individual/s is/are bound to an ASBO there is different funding that becomes available ... it is simply a costing exercise really.

Then surely this case illustrates that there should be, rather than abusing the ASBO route.
Miriam Binder Posted - 28/07/2007 : 22:11:17
There are Fluffy ... local authorities are obligated to facilitate a mediation service I think. However there is no way of forcing people to attend.

LT, NONE of this is `normal`! Sorry folks, but my first reaction to this was `if I was the magistrate I`d tell both sides to bugger off and grow up, stop wasting the court`s time, etc. Swearing loudly, shouting, ok, that`s anti-social, but singing?? And to blame this as the reason for the other childish daft mare `having to give up` running her own business?! What, she had to stay home to listen out for any more singing so she could complain about it?
I`m more inclined to wonder how the rabbits were after the bonfire smoke, I`ve very little sympathy for any of the humans involved in this case....

But I do honestly think this is an abuse of the ASBO. I think there should be some kind of `Relate`counseling for situations like this, both sides ordered to attend by the court, if need be, and that should be the only court involvement till that approach has been thoroughly tried.
We need to keep ASBO`s for protecting communities from real anti-socials, not for disputes like this between childish timewasters.

That is not normal
She is a Big Singer - Loud.
And singing Outside - ASBO is the only way to deal with her.

If she was in a Better Property
no problem.
